Section 1 - Object

The Game is free to enter and consists of the prediction by members of the results of 10 football matches played on each Saturday of the 2003/4 English football season. Prizes are awarded according to the accuracy of these predictions.

The Game is accessible:

(i) on the website whose Internet address is www.predicttowin.com (hereinafter referred to as “the Site”) or any other URL address, hyperlink, index or button put on another website and redirecting to the Site.

(ii) and, as the case may be, on any other website/wap substituted for the Site.


Section 2 - Details of the Game

2.1 The Game is open to residents of all countries.

2.2 The Game is divided into three league systems, each with different scoring criteria:

- ‘The Predictions League’ operates according to a points system, which relates to the accuracy of the members’ predictions of the specified matches. Members receive 1 point for each ‘correct outcome’ (i.e. if they correctly specify which team will win or lose, or that the match is drawn). Members receive 2 points for each ‘correct result’ (i.e. if they correctly specify
the exact score line of a match). Each point has a monetary value of UK£0.01p.

- ‘The Bonus League’ operates to a system whereby points are allotted according to members achieving certain specified targets. Members receive 50 points if they are the highest points scorer in the Predictions League between the first day of each month (the ‘monthly winner’). In the event that more than one member achieves the highest monthly score, they shall each receive the 50 point bonus. Members receive 30 points if they earn at least 1 Prediction League point for each match in a single round of predictions in the Predictions League. Members receive 50 points if they refer a new member to the Site. There are no limits to the number of referrals that a member may make. Each point has a monetary value of UK£0.005p.

- ‘The Champions League’ operates according to the Predictions League points system, and is open only to the 16 highest point scorers in the 2002/3 Predictions League game.

2.3 Members accumulate points in both the Predictions League and the Bonus League, with the final points totals converted to a combined monetary value. Each member will then receive payment of his or her accumulated winnings following the completion of the 2003/4 English football season.

2.4 Throughout the season members will receive offers both by e-mail and on the Site that will award bonus points as an incentive.
The number of points shall be specified when each offer is published, and will apply to the Bonus League.

2.5 As well as the money earned from prediction points during the season, the members with the three highest points totals in the Predictions League at the close of the competition will also be eligible for extra cash prizes. The member with the highest points total will receive UK£500 (the ‘Grand Prize’) in addition to their other winnings. The member with the second highest points total will receive UK£200 in addition to their other winnings. The member with the third highest points total will receive UK£100 in addition to their other winnings. In the event that more than one member is eligible for the Grand Prize, the winner shall be decided according to which member has achieved the greatest number of ‘correct results’. If there is still a tie, the winner shall be decided according to which member has achieved the greater number of ‘correct outcomes’. If there is still a tie, the £500 shall be divided equally between all those with an equal points total. This ‘tie-break rule’ shall also apply to the winners of the £200 and £100 prizes should the situation arise.

2.6 As well as the money earned from bonus points during the season, the members with the three highest points totals in the Bonus League at the close of the competition will also be eligible for extra cash prizes. The member with the highest points total will receive UK£200 (the ‘Big Bonus Prize’) in addition to their other winnings. The member with the second highest points total will receive UK£100 in addition to their other winnings. The member with the third highest points total will receive UK£50 in addition to their other winnings. In the event that more than one member is eligible for the Big Bonus Prize, the winner shall be decided according to which member has achieved the greater number of points in the Predictions League. If there is still a tie, the winner shall be decided according to which member has provided the greatest number of confirmed member referrals to the Site. If there is still a tie, the £200 shall be divided equally between all those with an equal points total. This ‘tie-break rule’ shall also apply to the winners of the £100 and £50 prizes should the situation arise.

2.7 Each player can submit only one set of predictions per group of matches. However, these predictions can be altered via the Site prior to 14.00 on a Saturday for a weekend group of matches.

2.8 Only players with a valid participation can earn points in the Predictions League.


Section 3 - Terms and Conditions of Participation

3.1 Participation in the Predictions League Game can only be made by electronic means on the Site. The connection to the Site can be made via a computer connected to the Internet.

3.2 The Game is open to participation to individuals who are at least 13 years old on 11th May 2003.

3.3 The number of players per household is limited to 2 players of the same surname and personal postal address.

3.4 Entry of the Game is not open to anyone who has been involved in organising or promoting the Game.

3.5 To participate players must go on the Site and fill in the registration form which is available on the Site. Players must complete all the requested information (title, surname, first names, date of birth, telephone number, personal postal address, e-mail address, username and password). In addition players may, as the case may be, give the e-mail address of the person who introduced them to the Site. When registering on the Predict To Win website, players agree to receiving member offer e-mails from Predict To Win and its affiliate partners. The majority of these e-mails will offer bonus points for the Bonus League as a reward for registering with Predict To Win’s affiliate partners.

Where the player has already participated in the game and agreed that a ‘cookie’ be placed on his/her computer the player will not have to necessarily fill in the registration form if the requested particulars have not changed. However, he/she will have to ensure that their username appears on-screen. If the player’s particulars have changed he/she will be responsible for updating them, otherwise the player’s participation will be deemed void.

If the player has already participated in the game but refused that a ‘cookie’ be placed on his/her computer, the player will only be asked to give again his/her username and password.

3.6 Any registration form containing one or more errors will be deemed void. If the player omits one of the requested particulars when filling in the registration form the player will be invited by a notice to complete the particular concerned. Failure to complete all particulars will render the application void. All details must be accurate and relevant to you (the individual player) and your details for you to claim your prize. You may not fill in a form or play the game on someone else’s behalf. To do so will immediately disqualify that person’s predictions and your own predictions for the remainder of the competition.

3.7 To participate in each round of predictions every player, having specified their predictions for the forthcoming matches, must validate his or her prediction form by clicking on one of the advertising banners posted on the Site at that time.

3.8 Each player will receive within the 24 hours following the submission of their predictions an e-mail confirming his or her participation in that round of predictions. By registering with Predict To Win, the player agrees to receive occasional newsletters detailing game developments and site news.

3.9 Every player can only play one set of predictions per group of matches. Participation in the Predictions League weekend game will be closed every Saturday at 14.00 UK time. The prediction form will be deemed received by Predict To Win at the time the latter can access it rather than the time it was sent.


Section 4 - Allocation of Points

Following the completion of all matches in each round of predictions, Predict To Win will calculate each member’s points award for that round of matches. The results of the matches concerned will be posted on the Site approximately 30 minutes after the completion of all matches. Every player who has participated in that round of predictions will be sent an e-mail within 24 hours of the completion of all matches, containing details of the points awarded to them following the outcome of these matches and their current total points score and league positions.

In the event that a match specified on a prediction form is either postponed or abandoned, predictions for that match shall be deemed void.

Predictions League points shall be allocated to players as follows:

(i) 1 point to players who have correctly predicted the outcome of a match.
(ii) 2 points to players who have correctly predicted the result of a match.


Section 5 - Winners of Bonus Points and Cash Prizes

5.1 Bonus League points shall be allocated to players as follows:

(i) 50 points to the player/players that has/have scored the greatest number of points in the Predictions League between the first day of each month.
(ii) 30 points to players who have received Predictions League points for each match in a round of predictions.
(iv) 50 points to a player whose e-mail address has been submitted as that of a referee to Predict To Win by a new member.

5.2 Cash prizes shall be allocated to players as follows:

(i) UK£500 to the player that has scored the greatest number of points in the Predictions League at the close of the competition.
(ii) UK£200 to the player that has scored the second greatest number of points in the Predictions League at the close of the competition.
(iii) UK£100 to the player that has scored the third greatest number of points in the Predictions League at the close of the competition.
(iv) UK£200 to the player that has scored the greatest number of points in the Bonus League at the close of the competition.
(v) UK£100 to the player that has scored the second greatest number of points in the Bonus League at the close of the competition.
(vi) UK£50 to the player that has scored the third greatest number of points in the Bonus League at the close of the competition.
(vii) UK£50 to the player that has scored the greatest number of points in the Champions' League at the close of the competition.
(viii) UK£20 to the player that has scored the second greatest number of points in the Champions' League at the close of the competition.

5.3 Winners of Bonus League points will be informed by e-mail.

5.4 Winners of cash prizes will be informed by e-mail, and the value of the cash prize added to their total winnings (i.e. that acquired by converting their Predictions League, Bonus League and Champions' League points totals into UK£).

5.5 Following the end of the 2003/4 English football season, Predict To Win will calculate the monetary value of every member’s Predictions League, Bonus League and Champions' League points totals, as well as any cash prizes won. Every member who has earnings amounting to UK£1.00 and above, will receive their earnings through either PayPal, MoneyBookers or No Chex. Each of these members will also receive an e-mail informing them of their total earnings and confirming that their payment has been sent. Members who fail to reach UK£1.00 in earnings will not receive any payment.

5.6 To be eligible for final payment, the player must provide his/her correct details in full at the time of registration. From that point forwards, his/her details must be correct, and refer specifically to himself/herself, at the time of receiving any payment. Players may alter their registration details at any time through “Your Details” on the Site. Furthermore, only the person who holds the registered name and address may play his/her game. No one may play on a registrant’s behalf at any time, as this does not constitute an action of the registered player.

5.7 When accepting a cash prize, winners of the Grand Prize and the Big Bonus Prize explicitly authorise Predict To Win to use their surname, first name and picture and to mention the name of the city, county and/or country where they reside. These particulars can be used in any promotion or advertising using any support, as well as on the Site and any other website featuring the Game in the UK or abroad for 2 years. The use of these elements by Predict To Win will be free of any payment or remuneration, other than the payment of the prize.

5.8 Winners will be responsible for payment of any tax or other fees that may be payable by them in accordance with any applicable statutes and other laws and regulations. Predict To Win will not be held liable in this respect.


Section 6 - Limitation of liability

6.1 Participation in the game implies knowledge and acceptance of the features and limits of the Internet, especially as regards technical performances, response time to consult, ask or transfer some data, risks of interruptions and more generally the risks inherent to any connection and transmission on the Internet, the absence of protection of some data against possible misappropriation, fraudulent use and the risks of contamination by bugs present on the network.

6.2 Participants recognise that they are playing the game for fun only, and that they are not required to make any payment or other contribution to enter the game. As such, it is not intended that any contract will exist between the players and Predict To Win.

6.3 In any event, Predict To Win will not be liable on any basis, for any of the following reasons, the list here below being in no sense limiting:

(i) the content of the services consulted on the Site and, more generally, for any information and/or data issued on the services accessible on the Site;
(ii) the transmission and/or receipt of any data/information on the Internet;
(iii) any malfunction of the Internet network which may prevent the proper course of the Game;
(iv) any breakdown of any reception equipment or communication lines;
(v) the loss of any mail, whether on paper or under electronic form and more generally for the loss of any data;
(vi) carriage problems;
(vii) the proper functioning of any software;
(viii) the consequences of any bug, abnormal event, or technical failure;
(ix) any damage caused to the computer of the Player;
(x) any failure, whether technical, material or related to a software, whatever the reason, which prevented or restricted the possibility for the player to submit their prediction form or which damaged the system of the player.

6.4 Predict To Win will not be liable on any basis for any damage whether direct or indirect due to a disruption, malfunction for any reason, interruption or termination of the Game whatever the reason, nor for any damage whether direct or indirect which will result, in any manner, from connection to the Site. It is up to the player to take all appropriate measures in order to protect against any breach of his/her data and/or software stored in his/her computer. The players are solely liable for their connection to the Site and their participation to the Game.

6.5 Predict To Win will not be held liable, in any case, in the case of Force Majeure or any other event beyond its control.

6.6 Predict To Win will be free, in any case, to change any date and/or time announced. The change will take effect as from the time of posting of a notice on the Site.

6.7 Possible amendments, which can be issued during the term of the Game by notice posted on the Site, will be deemed amendments to the present Rules. Predict To Win also reserves the right to cancel any particular Game or generally to cease running the Game at any time by posting a notice to such effect on the Site. In the event that Predict To Win ceases to operate, members accept that all member earnings to that point will be cancelled.


Section 7 - Personal Data

7.1 The personal data about members will be used pursuant to the 1998 Data Protection Act. Each member will have a right to
access, rectify or delete any and all information concerning the member.

Section 8 - Duration - Modifications

8.1 The Terms and Conditions apply to any Player who enters the Game in filling in a registration form.

8.2 Predict To Win will be free to modify the Rules and/or the Site, at any time, without notice or obligation to justify its decision, and Predict To Win will not be held liable for doing so.

8.3 Any modification to the Rules will be deemed in force as soon as notification is put on-line. It will be deemed accepted by any player submitting their predictions after that moment. Any members disagreeing with the modification will have to stop participating in the Game.

8.4 Predict To Win will be free at any time to interrupt the Game without notice or justification. In any case, Predict To Win will not be held liable for so doing and players will not be entitled to claim damages whatever their form.

8.5 Predict To Win will be free to sue any person who commits or attempts to commit a fraud. However, Predict To Win will not be held liable to any player for any fraud that may have been committed by any third party.

8.6 In the case of any infringement of the Rules by a player, Predict To Win will be free to reject that player’s participation, and the player will not be entitled to appeal against this decision.


Section 9 - Uniqueness of the Game - Applicable laws

9.1 Predict To Win is a single and unique game, including the same terms and conditions of participation and the same guarantees, whatever the number of countries where it is applicable.

9.2 The present Terms and Conditions are subject to English Law.
